Terms and Conditions

These campaign draw terms and conditions (“Draw Terms”) govern the terms and conditions applicable to Buy or Bye LLC (“Buy or Bye”, “We”, “Us”, “Our”) campaign draws (“Campaign Draws”) that relate to our website (“Site”) and our customer ("User", "Platform Member" , "You").

By using the Site and/or participating in a Campaign Draw, you agree to be bound by these Draw Terms, as well as the user agreement published on the Site (“User Agreement”). If you do not agree to these Draw Terms, or any of its terms (including any amendments), then you should immediately cease using the Site, and not enter any Campaign Draw.

Campaign Draws will be approved by the Ministry of Social Solidarity (“MSS”) in the Arab Republic of Egypt (“ARE”) and are in accordance with the Commercial Permit Guidebook (as such may be amended from time to time). A valid permit number will be issued for each respective campaign. Where Campaigns are being run from any other jurisdiction we operate from, Buy or Bye will obtain the necessary regulatory requirements and permits as stipulated by the law in such jurisdiction.

Only Users with a valid membership to the Site (“Site Members”) that satisfies all the terms of the User Agreement are eligible to enter into our Campaign Draws.

Each product purchased from a campaign by a Site Member is awarded a single Site ticket per product to a specified Campaign Draw.

A Site Member will have the option to either collect the purchased product or have such contributed to a charity of Our choice. If a site Member opts to so contribute their purchased product to charity, Buy or Bye will provide the items to said charity after the draw date.

Complimentary ticket numbers are computer generated and sequential to the order in which the products they are associated with are purchased. Site Members cannot choose ticket numbers as they are generated only upon checkout and completion of purchase of the associated products.

Product and the Complimentary tickets awarded to Site Members are neither refundable nor transferable and are owned solely and exclusively by the Site Member who they have been awarded to.

 

Draw Guidelines

Only Users with a valid membership to the Platform (“PlatformMember(s)”) that satisfies all the terms of the User Agreement are eligible to enter into our Campaign Draws.

Each product purchased from a campaign by a Platform Member is awarded a single complimentary ticket per product to a specified Campaign Draw.

A Platform Member will have the option to either collect the purchased product or have such contributed to a charity of Our choice. If a Platform Member opts to contribute their purchased product to charity.

Product and the Complimentary tickets awarded to Platform Members are neither refundable nor transferable and are owned solely and exclusively by the Platform Member who they have been awarded to.

Each Campaign runs a draw and consists of one winner unless stated otherwise.

The draw is conducted through the supervision of the Ministry of Social Solidarity and Consumer Protection Agency.

The draw is presented live on social media platforms on the set draw date of each campaign. The draw date indicated on the campaign box of each Campaign Draw is the maximum date that a Winner will be announced for that specific Campaign Draw. Buy or Bye retains the right to bring forward the draw date at any time.

The deadline to enter any Campaign Draw is prior to the sell out of all units within the specific Campaign Draw, or prior to the closure of the Campaign Draw before the draw date, or in the case of timed Campaign Draws; prior to the end of the timer displayed on the campaign box of the specific Campaign Draw.

After determining the winner, an e-mail is sent to the winner with the name registered to the account to receive the prize.

To receive the prize the winner must present a valid ID or Passport and sign a declaration.

All Platform Members consent to the use of their name, photograph in the event they are the Winner of any of the Campaign Draws. This includes but is not limited to use of their name in the local and regional press, on the Platform and on any social (online) media profile associated with Us

All Platform Members consent that We have the right to use any and all digital records made by Us including, but not limited to, photographs, videos and call recordings of, the Prize, the Campaign Draw, the winning phone call and the collection of the Prize, on the Platform and on any social (online) media profile associated with Us. These digital records may include imagery and/or voice recordings of the Winner and/or their name.

In the event the Winner is based in the Egypt, then he/she needs to collect the Prize from Our premises within 60 calendar days and present valid identification as may be required in Our sole discretion. Buy or Bye may, at its sole discretion, allow an individual who has been given Power of Attorney (POA) by the account holder to collect the Prize having presented the necessary identification, Buy or Bye will evaluate such instances on a case by case basis and cannot guarantee that an individual with POA will be allowed to collect the Prize on behalf of the account holder. Failure to collect the Prize within this time period WILL result in Us transferring the Prize to the regulator whereafter Buy or Bye will have no further responsibility with respect to the Prize. Post transfer, the Winner must liaise with the regulator whereupon he/she will be subject to the regulator’s own terms and conditions.

All Prizes represented on our Platform, will be awarded as displayed. Minor changes, including but not limited to color, may occur, however, no major changes, including but not limited to, specification, brand or value, will occur.

Buy or Bye is not responsible for any bank charges, including but not limited to processing fees from Your local bank.

By entering the Campaign Draw, Winners confirm their agreement to take part in any associated publicity.

We will not be responsible for claims, damages, or expenses of any nature whatsoever for any loss, illness, bodily injury, including death, of or to any Winner and/or any third party during and/or in course of usage of any Prize or due to any defects in any Prize.

 

Indemnity

You shall indemnify and hold harmless Bye or Bye, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party

penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

 

Liability

You further agree and acknowledge that Buy or Bye should not be liable to You or to any third-party for any of the following:

1. Damages, or harm from any kind that results from Your access or use of the Platform.

2. Any interruption in communication to or from the Platform.

3. Any bugs, viruses transferred through the Platform.

You shall defend and hold Bur or Bye and its affiliates, employees, agents, shareholders, and directors harmless against any claim, action, demands, expenses, and damages, whether actual or consequential of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with Privacy Policy, your use of the Platform, violation of any laws or regulations and any misleading information/data You may provide, at any time.

You hereby acknowledge and agree to indemnify Buy or Bye, its affiliates and employees from and against all losses, damages, costs (including, but not limited to, reasonable legal and other professional fees) expenses any other liabilities incurred by or awarded against Buy or Bye, its affiliates or its employees in this regard.

You hereby release Buy or Bye, its officers, employees, agents, and successors from any and all claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected, and unsuspected, disclosed, and undisclosed, arising out of or in any way related to Your use of the Platform.

 

Applicable Law

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of Egypt. The place of jurisdiction shall be exclusively in Cairo.

Trademark, Copyright and Restriction

This site is controlled and operated by Buy or Bye and products are sold by respective Sellers. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights.

Material on Site is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so.
